To the Chief Adviser, Dr. Fakhruddin Ahmed
This message has been in the making for a long time. We were hoping that we would not have to send this out. The fact that this is published now, it should act as an alarm for your government.
 
A note to readers: If you agree with this message, please each one of you forward it to feeedback@pmo.gov.bd, so he knows how many people favours this. This is very important! 
 
A valid question or issue that can be raised is this - why did we change our position on the issue of trial of war criminals now  - whether it shoudl be done by the interim government, as opposed to our initial position of trying them by an elected government? We have touched on the issue in earlier occassions, but we did not really address the issue directly. Why change position in such an important issue and why risk embarrasing the current government whose capacity is alreay limited by a time bound roadmap and also, they have taken so many projects that it should be already too much for them. We agree. Still, we changed our position with a sane mind. Why? 
 
Frankly, changing our position on this issue has nothing to do with the issue itself. Surprised, huh?
 
Let us explain.
 
Just look around. There are many people who do not beleive that this issue will be addressed by the government who will be elected through the election for which your people are so on-work. Your promise of free and fair election in a level playing field. Yet, people still do not beleive that your project will be eventually successful. Why? It seems the perception is that the old faces will be coming back to form the government.
 
Not only the other people, your own government, including yourself, are part of the same public. You also do not beleive that there will be new political parties coming to power. It will be the same AL or BNP or their combination with other smaller evils. This is - even when - they have not changed their actions and words a tad.
 
The fact that you think they will be coming to power again is demonstrated through the words of your governemnt. You guys talk about why AL or BNP is not reforming themselves. Why do you care? If they want to keep the culprits on top, if they want to stay un-reformed or ill-formed, let them be. Shouldn't a level playing field ensure their defeat - if they do not reform? Can you see the logic? People are not stupid. People of Bangladesh never voted the wrong people - they always vote for the best choice at the time. The question is whether there will be alternative to traditional choices?
 
So, what is the problem? You can not achieve what you initially thought? At least, the body language suggests so. Or is it the fact that you plainly can not complete the project, the project definiiton was faulty given the resources? If you think its doable, why dont you talk about resources? Why not get people on board with what your thoughts are on this?
 
So, if that is the case, then why shouldn't we expect that you do at least one thing. Try those criminals. At least, you can do that. Changing a corruption economy is much more complex a problem than trying some criminals - specifically when that was done at the birth of the country. So, we thought. Do you see the logic that justifies change in our initial position on the issue? If you can not deliver the real thing, why dont you at least deliver this? Hope we have communicated our logic well so all know.
 
Lastly, as we do always, here are some problem solving.
 
Is there still any way to salvage the project? Yes, this is a great project of reconstruction to many of us Bangladeshis. That is why they have given you - an unelected government - to govern more than anybody could even think. We would be inclined to say that yes, there is still time to achieve the mission. We have written about it before. Let us repeat for the benefit of the readers.
 
You can not change nature of the politicians, with the resources you have (particularly less time). It is true. But you can change the dynamics of the socio-political structure. There are many ways to do that. Given the timeframe you have left, here is the most effective one.
 
There have always been a competition for the elected positions in various level of governance system (starting from UP member to MP). Many people vie for those posts. But so far, only the corrupt ones have gone for that. No serious people who are also honest have ever dreaded to compete for those, except for few lucky ones who were born in very rich family. You have to make these positions attractive to the honest people. This has to be done in such a way that being rich is no longer a pre-condition. Our suggestion is that you give a monthly salary of at least 50 paisa per month per voter for these elected office-holders (instead of current declaration of meagre doubling the TK 1500 to TK 3000, that is funny). If this policy is adopted, that would make these positions attractive to the competent people in a way that will change the dynamics of politics in Bangladesh. We know what many of our readers are thinking. We do not blame you guys. Its not your fault. Even our best intellectuals will also be saying the same. For example, you ask Dr. Wahiduddin Mahmud or Dr. Yunus or Dr. Muzaffar Ahmed or any other respected intellectuals, they will tell you that its not a good idea. People should come to public offices to serve the country, not for money, blah blah blah. Behind this assumption, they think that only the sons and daughters of the rich are entitled to compete for the election. That basic assumption is false and that is destroying our democratic foundation. If our this assumption is true, that would explain the root cause of many of our problems. This mindset is coming from last century.
 
You guys assume that all who are competent are born in the elite families. You couldn't be more wrong. Look at the local level leaders. Lives of most of these leaders are not only a story of rise in corruption, there are also many a story of rising economic condition. They become ward member because they think that is only way to make a decent money. To do that they first become mastan. And some percent eventaully succeed, the smarter ones. Though that is wrong way. But what is the alternative? If a honest person even somehow becomes elected, what is he supposed to do after being elected? Run his family for 3000 taka and still be popular chairman? Or do you want these few honest people do the impossible jobs, and then go asking for money to the rich of the soceity to run his family?
 
Our system do not prize the honest and competent. We currently have a system which punishes, if you are foolish enough to be honest and talk your mind.
 
Say for example, somebody does a job which pays him taka 30,000 per month. He has achieved this through hard work, honestly, during his last 35/40 years of life. This monthly salary is probably his only life-line to support the family, because none of his father or father-in-laws were theives, let alone himself. So, what choices do you give him, if he wants to go back to his village and fight for the UP chairman or a ward member position? Being elected itself a big challenge. Your election commission has a lot of work to enable this type of candidates to get a level-playing field in the villages. Is there a legal way for this person to raise money for election spending? Can he open a bank account and receive donation for running for office?
 
Or say a person who is earning 1,20,000 taka from a job, and he is considering to go for MP candidacy.
 
There is no legal framework for these two person to raise their funds from their personal network, if they want to. Election commision will have to figure that out soon. Time is running out.
 
But our today's talk is not about that. We are assuming that election commission will do that effectively and sooner than later. But then comes the policies that you make or your advisory council make.
 
Once these type of candidates get elected, if they gets upto there, what does he do to make sure that their families are still being fed well and their children being sent to a good school? Have you ever thought of making a budget of your elected official - the type that you so often talk about - the honest and competent ones? If you have not done so, you better do that. Do not assume that all of them will have their savings account or father's money to support their families. Few might and be still honest, but many wont.
 
Do not expect that their budget will come from out of pocket. It will either come from corruption (the traditional candidate) or from the government exchecker (because most of your honest and competent candidates do not have money or do not come from rich families)!!
Off course, unless you make a provision to receive donation for personal spending which we think is a bad idea.
 
So, unless you make sure that you change the incentives and framework so that the nature of the competitors are changed, you can not make any significant effect in the system. You have to change the stuctural parameters, if you really understand the problem and you really mean what you say. If you do this, the positive result will be much better than you can think of. Don't beleive us? Ring in some top rated professor in social system dynamics or application of complexity theory in social systems and ask them to run a simulation on this. MIT or Stanford or INSEAD or Tokyo or NUS or many other similar schools have such experts. To do this, to pay for the expenses of the elected officials, is not a big amount for the nation. If we expect a positive result, the money figure is manageable. The other article for we earlier provided link has some calculation. This seemingly insignificant injection of energy into the structure has the capacity of changing the system within a very few years time. Moreover, you do not have to go that far in doing simulation. You have a real example closer to home. Singapore and many others are reaping the benefits of such policies.
 
If you can not or do not have the courage to do this, then give us a break - bakhwas should be stopped. The fact that your government is not stealing money, the mastans are mostly gone, you are trying to reform the bureacracy and the police, etc are good enough reason to praise you. But there is no need to increase the expectation of the populace in saying that they should expect a good government or good leadership after this election. Beyond your tenure, let "A story of a thirty some" to continue for some more years (To read the story, see http://launch.groups.yahoo.com/group/vinnomot/message/10977). It won't be as bad as it were pre-1/11. But there is no gurantee that your cosmetic and half-hearted reform efforts will make a strong enough dent to reverese the degeneration in the system.
 
Dear readers, still there is no need to be dishearned. Our changes will be much slower than we thought we would be getting. After all, you represent a failed generation - what better could you do? For the same reason, we had earlier opposed the idea of Dr. Yunus's joining politics with the banner of NaShok. With such a bunch of incompetent, hypocrite and closed-minded generation, we actually should not be expect much better than this. 
 
If public thinks that the current government is not doing everything in their reach to establish good governance, it would be an opportunity lost. Please, please, please. Take actions to inject some honest energy in the system. Take actions to make a competition among honest and competent, not a competition among the corrupt and culprits. The fact that you are running the country, is unconventional. So, do not hesitate just because some bureaucrat tells you that its unconventional, or can not be done. Think for yourself.
 
If you do have have the will to do that, then try the war criminals, at the least.
 
We think both can be done. Start the war crimes commission by this Independence Day. Then start the elections of the local government bodies, under the proposed policies. And once all is over, hold the general election. All of these can be and should be done.

Penglipuran culture village is located in Bangli province which is 45 km from Denpasar. This village is one of the tourist spot that easy to visit, because of its location is in the main street of Kintamani - Bangli.


This village still upholds their traditional culture. Its nature culture can be notice when we enter the area. On Catus Pata area which is a border to enter this village. Over here, there is a village meeting community facilities and arrangement and an open outdoor yard as a welcoming symbol for the visitors.


This village is one of the villages in Bali which has an order arrangement system from the traditional village structure. It is a combination of open space yard outdoor which still natural, so it will remain us the Balinese environment in the past. The village physical structure order basely on their traditional culture that they uphold up until present time and their community culture already exist for generation.


One of the best thing about this village compare with the other village in Bali is that the front houses shape are look alike from the edge of the main village until downstream of village. The houses are order properly that the main area is located in a higher place and keep on decreasing until the downstream area. Despite of their same shape of physical look they also use the same materials in making the houses. For example they use the soil to color the wall and for the roof made from "Penyengker"and bamboo for all houses in the village.


Because of its location is in the high land, the atmosphere here is very fresh. In spite of its natural park, the local people are very friendly and welcome to the visitors. A lot of tourist who dropped by can enter their houses and enjoy the scenery when the local people make handy craft, so it will be a wonderful time to spend here.


This traditional culture village belongs to one of the village in Bali which held a lot of ritual activities. So there will be many activities that this village have, such as Ogalan raising ceremony and Ogalan lowering ceremony, Galungan etc. The right moment to visit this place is when the ritual activities held, so we can see directly its unique and it's exclusive. Even though you can't attend these ritual activities, you can enjoy the scenery of this village especially during the sun down, because at this time the local people usually go out from their houses after they had finished doing their routine activity which is from morning until the sun down. They will go out and gathered with the others, set their favorite rooster free and sometimes they do "Tajen" (a chicken match), but without putting a knife on the chicken's leg. Meanwhile waiting for the sun down you can enjoy chicken porridge in Mr. Made retail shop which is very clean, cheap and mixed with the local people, it was an amazing experienced I will never forget for the rest of my life.

Government should use the expertise of Professor Payam Akhavan on War Crimes
We hope that our journalist community will avail this opportunty to talk to this international expert on this very important issue.
 
While Professor Akhavan is in Dhaka, before he leaves town, the best thing would be if the Dhaka Reporters Unity arranges a Meet The Press event dedicated to the War Crimes issue. We hope that both the government and the media will seriously consider this.
 
Here are some excerpts on McGill Law Professor Payam Akhavan, who is currently visitng Dhaka as an observer.
 
 
 
Payam Akhavan
Professor of Law, Centre for Human Rights and Legal Pluralism

Professor Payam Akhavan was the first Legal Advisor to the Prosecutor Office of the International Criminal Tribunals for Former Yugoslavia and Rwanda and played a key role in the development of its foundational jurisprudence. He also has considerable experience in post-conflict peace-building and international dispute settlement, having advised the UN on transitional justice, appearing as counsel before international courts and tribunals on behalf of sovereigns, and serving on the board of directors of human rights NGOs, including the Iran Human Rights Documentation Centre in New Haven, of which he is also the president and co-founder. His work has been featured in the New York Times and, in recognition of his contributions to promoting accountability for human rights violations, he was selected by the World Economic Forum as a Young Global Leader in 2005.

Biography

Professor Akhavan teaches and researches in the areas of public international law, international criminal law and transitional justice, with a particular interest in human rights and multiculturalism, war crimes prosecutions, UN reform and the prevention of genocide.

He was previously the Boulton Senior Fellow at McGill, Distinguished Visiting Professor at the University of Toronto Faculty of Law, and Visiting Lecturer and Senior Fellow at Yale Law School and the Yale University Centre for International and Area Studies. He has published extensively including "Beyond Impunity: Can International Criminal Justice Prevent Future Atrocities?" (2001) 95 American Journal of International Law 7 (www.asil.org/ajil/recon2.pdf) selected by the International Library of Law and Legal Theory as one of "the most significant published journal essays in contemporary legal studies." He is also the author of the Report on the Work of the Office of the Special Advisor of the United Nations Secretary-General on the Prevention of Genocide (2005).

[Shadeshi_Bondhu] Fwd: What BTRC Chairman said about BD Internet Bandwidth Price

Recently, i read an interesting mail written by amir hossain. I'm just forwarded the mail here to share the things, he wants to say:




Dear all:

Since long time we are talking about internet price but still realization by the policy maker is very poor. Only BASIS is playing a very active role on it but still no success. The policy makers are not taking it as a very important issue for development of ICT in
of the country. Recently govt. has reduced the price some where about 30% but it still looks funny.

According to the BTRC chairman in his recent comments published in "the daily star" said, BTTB bandwidth price is abnormally high and he added it should be come down to TK 10,000 per mega bites where presently it is TK 80,000 per mega bites.

He also said that, the price of one mega bites is around taka 1725 in India and Pakistan. So, we can understand where we are. If the price comes down to TK 10,000 per mega bites, still it will be around 6 times higher than India and Pakistan.

My concern is why govt. is focusing on gaining huge margin on its cost for internet bandwidth? Is it an IT friendly step? Or it is because of some concern business who really working against the national benefit for their personal interest?

If the price of internet bandwidth can be lowered or distributed without margin (no profit no loss) stage I think people will return the nation many times than it is presently gaining from the margin. It's a very important raw material for national ICT development
and ICT export earning. So govt. should thing it with highest interest for creating an environment where ICT can grow with full pace.

A question for the ACC Chairman
There is a serious concern about the ability of ACC to sustain its activities irrespective of who is running the government. ACC should demonstrate that it can take on the executive branch, if needed.
 
 
Here is question that needs to be asked:
Do the success of your organization depend on the attitude of the sitting government towards your work?

Yes or No?

Our assessment of your work, your words and your message so far is that you would be likely to answer to the question as 'Yes'. Don't you think so?


If that is the case, what will then happen to the anti-corruption drive if a government comes to power which is not aiding your work, but blocks your work. Can you imagine that scenario? What do you get then?

Allow us to help a little bit more. Let us assume that there is a new development in the government. The current council of advisers and the major political parties decides that a government of national unity will be beneficial for the country during next few months before an election be held. Accordingly, the majority of current council of advisers relinquishes their duties and position, and a set of seasoned political leaders joins the government as advisers. What happens to your cases against the politicians that you are currently pursuing?

Do you follow what the government wishes or you stick to your policy (if you actually have an independent policy)?

Bottomline: You have to recognize that you have to stand against the will of the executive branch from time to time, if you really want to be perceived as the successful anti-corruption commission. If you agree on this point, when would be a good time to start practicing that? Now is the best time. Certainly, this government has many elements that are undesirable. Choose your fight among them.

Show the people of the country (who are the main stakeholder of your organization) that you can tackle the executive branch of the government or even the corrupt elements in the judicial branch (if possible). Only then your service to the nation will be complete.

A closer look at the perceived successes of ACC - is it a success yet? We don't think so.
Whenever one talks about successes of the current interim government, the name ACC come. But if you were to given a chance to criticize this vital organization, what would say? What are the weaknesses, if any?
 
 
The biggest challenge of ACC to challenge the ruling government, sometimes. Let us clarify this statement in details.
 
The art of governing is often compared to art of how well one can accomodate the power brokers of the system. No matter what kind of government is there in power, political or non-political, honest or corrupt, based on the experience and character strength of the members of the government, they make differing level of compromises with different power brokers. The main challenge of ACC should be to make sure that while making those accomodations, there is no systematic problem. Identifying and fighting that systematic problem is the biggest challenge of the ACC. That would mean to fight with the government power. Sometimes that may bring embarrasment to the government - you should not fear that. Even if it is a interim government, presumably all good people, ACC is still entitle to embarrass this government. In fact, we would argue that your success as an institution would be counted on how many times you have managed to embarrass the government. Off course, your job is a bit subtle. The opposition always try to embarrass the government - they do it in order to weaken the government. But you would embarrass the government in order to strengthen it. So, you have to be very careful in choosing cases in which to embarrass the government. According to our scorecard, your score is still ZERO for last one year.
 
One may ask, while giving the current ACC a big zero score, can we suggest something that ACC has missed so far? Here is one.
 
So far, government has make one big compromise that is faulty. They probably do not see it. Or may be they don't feel that they are strong enough not to do that compromise. We do not blame them. Given the people in the government, it is quiet expected. They have made a compromise with the bureacracy. It is hard to fathom that "when 50 ministers are arrested, none of the secretaries of those ministries are yet to be arrested". Can you explain this? Its an anti-corruption drive that is skewed to favour the bureacrats. In our view, it is the job of the ACC, to correct this problem in the current government. If you do, it will be helpful for the government in the long run, even if they dont like it. It will also be helpful for you too. If some institutional process don't check the free reign of the original culprits, who have learned to stay low profile throughout career, people will at some point be frustrated and go into street again. So, its better for you do the job of people, steadily, so that we the people, can focus on our work, studies or whatever productive we are doing. Bottomline, you have to be seen as fighting the government. If you don't think so, you have a big a problem. Try to go beyond your lessons during military career. If you can't recreate your image and if you can not change the perception and instead you are seen as a fighter, you would also be shown the door. Before that day comes, you are smart enough to know what to do. But we want you to try to change the image. You have got few things right so far. You can achieve the rest of it, too, we believe.
 
Bottomline for ACC Chairman and his colleagues is this:
 
Govt. is bound to make some policy compromise. While they do those, there will be systematic problems. It is politics in its worst state, but it has been even worse before, now getting better. However, you should target the systematic problem in governments policy. In our view, you should target few of the 50 secretaries, even if that means small embarrassment for the government. This small embarrasment now, if you can make that happen, will save many big embarrasment for the government and for you.

[Shadeshi_Bondhu] BTRC sues GP big guns for illegal VoIP links

 

The telecoms regulator has filed a case against Grameenphone's (GP) two preceding chief executives and eight incumbent and former high officials of the company, charging them with involvement in illegal VoIP business.
 
GP, the country's largest cell phone operator, and Malaysian mobile phone operator DiGi Telecommunications have been also accused of "conniving" with Bangladeshi internet service provider (ISP) named AccessTel in the "punishable crime."
 
Norwegian state-owned telecoms heavyweight Telenor owns major stakes in both GP and DiGi.
 
Sub-inspector Manzur Ali Khan of Gulshan Police Station has confirmed that Zian Shah Kabir, assistant director of Legal and Licensing Division of Bangladesh Telecommunication Regulatory Commission (BTRC), filed the case (No. 46) on Jan 16.
 
The former GP officials accused in the case are CEOs Eric Aas and Ola Ree, Technical Director Thor Randhaug, Chief Technical Officer Yogesh Sanjeev Malik, and Sales and Marketing Director Mehboob Chowdhury.
 
The accused incumbent GP officials are Regulatory and Corporate Affairs Director Khalid Hasan, Chief Technical Officer Md Shafiqul Islam, Sales and Marketing Director Kafil HS Muyeed, Chief Financial Officer Md Aril Al Islam and Head of Revenue Assurance Espen Wiig Warendroph.
 
The regulator is carrying out further investigation to start prosecution, another Gulshan police officer told Sunday on condition of anonymity.
 
BTRC's written complaint says that a taskforce composed of regulatory and law-enforcing officials along with technical experts raided GP's headquarters in Gulshan on Dec 6, 2007.
 
It examined GP's call records and found its network was connected with AccessTel through four E1 links. It alerted the investigators and they hunted GP's internal records and emails from Dec 7-Dec 14 last year.
 
The probe revealed that GP's expatriate and local high officials were involved in unscrupulous VoIP operations. It also found that Malaysian mobile phone provider DiGi had been GP's overseas partner in the unlawful VoIP venture.
 
"The majority shareholder's consent to such illegal international VoIP operations has become apparent to the probe committee," the BTRC said in its written complaint to the police.
 
The regulator also spoke of GP's deliberate non-cooperation with the Rapid Action Battalion (RAB).
 
GP's Head of Revenue Assurance Espen Wiig Warendroph had verbally instructed his staff not to reveal the call records of a specific phone number to the elite crime buster. The number was found to have been used by AccessTel in VoIP call termination, BTRC said.
 
The investigators then retrieved emails of suspected foreign and local officials of GP. "It proves Grameenphone's high ranking officials' involvement in the illegal call termination business," the regulator said.
